Content to be acquired: 1. The beginnings of national laws in Europe. Customary law and influence of 1. Roman law. French, Spanish, Italian and Polish example. 2. The beginning of parliaments in Europe: England, France, Poland. 3. The absolute monarchy in Europe. The modern state. 4. Charles V and law in Germany: Constitutio Criminalis Carolina. 5. The ideas of the Enlightenment and their influence on law: program of codification of law. Cesare Beccaria and the humanitarian school of law. 6. English parliamentary-cabinet system and its influence on Polish Constitution of May 3rd 1791. 7. Napoleon and his codifications in Europe and in Poland. 8. Constitutional law of Poland 1918-1939 in European context. Fascist and authoritarian dictatorship in Italy, Spain, Poland. 9. The codification of law in the pre-war Poland. 10. The development of criminal law in 19th and in the first half of 20th centuries. 11. Poland as a communist state 1944-1989. Similarities and differences between other countries of Soviet block. |
Metody dydaktyczne: |
Classes. Presentations by students, discussion, comparing national legal history. |
Metody i kryteria oceniania: |
Each student will be presenting his/her studies on discussed topic. They will have to present selected problem of the history of law in their own coutnry's in comparision with history of law in Europe. At the end they will have to present a paper on the issues slected by them. The students must be present during classes. |
